The way digital business cards are applied is changing

Interventions and corrections regarding Digital business cardso that by the end of the year it will be fully operational in its entire scope Economy.Government plans two months before their implementation in industry, selling by pieces And Street markets (1the July).

A special group records the identified bugs and is expected to suggest solutions that will improve the implementation of the procedure. One intervention being considered is a small, flexible time limit, within which an employee can punch their card, without changing their working hours. This limit cannot be more than 15 to 20 minutes, before and after the end of the schedule.

Since last October, companies that have joined the electronic time measurement system have been given the option not to record changes in working hours and overtime before they begin to occur. This, according to retail workers, is the biggest problem with logging overtime.

Indeed, the Ministry of Labor is piloting the card in supermarkets, banks and insurance companies, which concerns about 500,000 workers.

According to the ministry, the digital labor card “is the ultimate weapon in the worker’s hands to fight illegal work.” After all, fines of €10,500 per employee are imposed for undeclared work, and thus a large volume of undeclared work has been diverted to declared work, causing harm to both the employee and EFKA.

The card will be implemented at approximately the same time as the new working time arrangement regarding weekend work.

In general and retail

Starting July 1, the digital card will be rolled out to street markets and retail businesses employing between 1 and 10 workers, a category that includes all licensed street vendors.

In particular, in the market sector, but also in any other type of business where employees do not start or complete their daily work from the registered office of the licensed employer-seller, the digital business card mechanism is different, as it applies only to employees who have a physical presence in Company Headquarters.

Therefore, in the case where the card is not punched at the beginning and/or end of the work of workers in the sector, due to the nature of the work subject, where the counter is set in a different place every day, the working hours for a specific day are assumed, the daily working hours announced in the system. ERGANI INFORMATION.

In the event of arrival after the start of the stated hours, or departure before the end of the stated opening hours, marking the card is necessary (as long as the arrival and departure are within the pre-specified hours). The above-mentioned sign is necessary, among other things, for reasons of legal security of the employee (eg accident at work).

The following terms/terms are warranties:

  • The employee has the right to refuse employment. In this case, any negative discrimination against him is prohibited.
  • If the employer cancels his assignment at any time before starting work, the worker is entitled to compensation equivalent to the daily wage for the work for which he was not assigned.
  • The contracting parties must agree on a minimum number of paid working hours, otherwise the detailed contract will be invalid.
  • The employee’s protective provisions relating to his or her contract or employment relationship apply, in particular to overtime, overtime and daily rest time.
  • Order contracts will be announced in PS ERGANI II and will be monitored by employees through the MyErgani application.
  • Customized labor monitoring will be carried out by the Labor Inspectorate and prescribed fines will be imposed for any violations of labor laws.

Where the law is violated

However, cases of circumvention of the procedure indicate:

  • Employees working on behalf of third parties (store-in-store) in cosmetics stores, shopping malls, spas, beauty centers, perfume shops, etc., do not “punch” the card.
  • Supermarkets, logistics services and department stores do not provide the possibility of a digital card to the contractor’s employees in the warehouses alongside their own employees, with specializations of order pickers and loaders.
  • Workers arriving at work at 5 a.m. were instructed to punch the card at 6 a.m. So that we don’t watch the night working hours at Arjani.
  • Security companies contracted to guard 24 hours – seven days a week for state facilities and buildings and its agencies, continue to implement the employment of guards 12 hours a day, with the digital card permanently “stamped” for employees in 8-hour shifts on weekdays and not on Sundays and holidays and always in shift. The day.
  • Contract cleaning crews in large buildings, affiliated with private as well as state companies, and whose main occupation is during night hours when facilities are not working, show “stamped” cards only during day shifts.
  • We point out to hourly workers that they should not forget to punch their card at 4 a.m., even though they continue to work until 8 a.m.
  • Online ordering clerks were instructed to tap their card regardless of whether they had completed their order or not.
  • Drivers have been asked not to hit the card at all.
  • Store managers asked workers to print the QR code from the cards for them, telling them they had the “obligation” of punching the card themselves.

Penalties and fines for each violation

In accordance with the Penal Code for non-compliance with labor legislation, the following penalties are imposed on companies that already use a labor card, as well as on companies that will be subject to this system:

  • Failure to activate the employee’s digital card (10,500 euros)
  • Providing employee digital card details that differ from the actual start or end of employment (€3,000)
  • Failure to provide the employee’s digital card data unexpectedly at the actual beginning or end of employment (3,000 euros)
  • Implementing flexible hours for an employee whose flexible attendance and digital work card are not activated (€2,000)
  • Non-compliance for a period of at least ten (10) years with the elements of the working time measurement system, as long as the control and verification of the employee’s financial claims in a public labor dispute are hampered (€4,000)
  • Failure to submit a statement of employment relationship data to PS ERGANI II in the event of changes in the statement data before the change is implemented and in any case before the employee concerned takes up service (€2,000)
  • Failure to submit a part-time employee’s “organization of working time” declaration in the event of a change in the organization of working time prior to the change and in any case before the employee takes up the service in question (€2,000)
  • Failure to submit a declaration of “organization of working time” to the fully employed person in the event of a change in time regulation (600 euros).

It should be noted that, in addition to workers, undeclared and unreported work also affects companies that enforce the law and are required to confront unfair competition for those who violate it. Therefore, dealing with these phenomena is a factor in achieving the restoration of healthy competition conditions in the labor market. In addition, adherence to labor legislation and dealing with undeclared and undeclared work, among others, also contribute to the reduction of the underground economy, as their income is recorded in the GDP.
