Who gets out on the pegs?

The public announcement of the names of megalophiles (natural persons and companies) is based on Law 3943 of 2011 With the aim of … discouraging them in order to force them to pay, but also (to avoid) setting an example for the rest of the taxpayers.

By publishing the list, it will be seen whether the large debtors have taken advantage of the possibility of moving forward in organizing their debts, by joining the list of 24 to 48 installments.

Based on current legislation, the total delinquent debt owed to the state from any cause must be announced each year on the AADE website, If the overdue principal debt of each natural or legal person or legal entity exceeds the amount of 150,000 euros Payment is delayed for more than a year at the date of extraction of this data from Tax Information Systems (TAXIS) and Customs (ICISnet).

What does the law say?

The law provides for the following debts to be excluded from disclosure, even if they meet the above criteria for the amount and age of the debt:

  • Debts that have been subject to a regulatory regime and respect its terms,
  • debts whose payment has been suspended by a temporary order, a court decision, an action of an administrative body or by law,
  • debts that are classified as uncollectible,
  • debts of the deceased or minors, and
  • Debt of legal entities within the narrow or broader public sector.

By joint publication of each natural or legal person or legal entity, details of total overdue debt from social security contributions are made public to EFKA. If the overdue principal debt of each natural or legal person or legal entity to EFKA also exceeds the amount of €150,000 Its payment is delayed for a period of more than a year at the date of extraction of this data from the OPS / IKA-ETAM information system of the Insurance Debt Collection Center.
