A court in the US state of Texas, where abortion is prohibited except in very rare exceptions, decided to allow the woman to terminate her pregnancy, because her pregnancy may threaten her life and fertility, according to her doctor.
The baby will die while she is carrying it
Kate Cox, 31, learned last week that the fetus she was carrying had Edwards Syndrome (trisomy 18) and asked to be able to go ahead with an abortion.
If she did not have an abortion, she would likely never be able to become a mother again
During an emergency hearing, Austin District Court Judge Maya Guerra-Gable granted her request, calling the idea that Cox might lose her ability to become a mother again “shocking.”
He stressed, “This would be a real miscarriage of justice.”
In the summer of 2022, the U.S. Supreme Court overturned Roe v. Wade,” who for half a century guaranteed the federal right of American women to terminate their pregnancies.
Banning abortion even in cases of incest or rape from 2022
Texas has banned all abortions, even in cases of incest or rape. The only exception: in case of risk of death or serious disability of the mother. But abortion rights advocates say the exceptions are too vague, and doctors fear facing legal action.
An ultrasound revealed that Cox’s fetus, who was 20 weeks pregnant, had spinal and abdominal abnormalities and that his skull and heart were not developing normally.
But because of Texas law, Cox was unable to get an abortion, as her doctors argued that their “hands were tied” and that she would have to wait for the baby to die during her pregnancy, according to the lawsuit. On her behalf by the Center for Reproductive Rights.
